Q: Will OESC contact my employer to verify if I quit or was fired?
A: Yes.
Employers pay the taxes that fund the unemployment program, so employers have a right to protest your unemployment claim. However, employers do NOT decide whether to award you benefits.
So, yes, OESC will contact the employer to find out why you separated. After you file your claim, a notice is mailed to the employer. The employer has 10 calendar days to file a written response with information about why you’re no longer employed. If the employer does not respond in writing, they will not have appeal rights to your claim. OESC will still call the employer to try to get information. Then, OESC will decide whether to award benefits to you based on all information they receive, whether that’s from you or from the employer. OESC’s goal is to issue decisions within 21 calendar days from the date they know there’s an issue on your claim.
